Schoolgirl drugged, sexually assaulted, and dies from poisoning; teenage suspect faces potential life imprisonment

According to a report by the New York Post on the 15th, a newly unsealed federal indictment reveals that 19-year-old Moises Freire provided fentanyl—disguised as cocaine—to two female students at the Fashion Institute of Technology (FIT) in New York. After consuming the substance in a dormitory, both women fell into a coma due to fentanyl poisoning. During this time, one of the women was sexually assaulted; she subsequently died from the poisoning. Freire also sent photos of the victim—who was left naked from the waist down—to a friend. Freire and an associate now face charges including conspiracy to distribute a controlled substance resulting in death and serious bodily injury. They could face a prison sentence of over 20 years, or even life imprisonment.

In the indictment, federal prosecutors described Freire’s actions as “sick and twisted.”

According to the investigation, Freire—a resident of the Bronx—arrived at a student dormitory on March 18 with a substance he claimed was cocaine, but which was actually fentanyl. He assured the two FIT students that the cocaine had come from Mexico and was free of any dangerous fentanyl.

Prosecutors stated that after consuming the substance, both women lost consciousness, suffering from acute fentanyl poisoning. While the women lay incapacitated—one of them just feet away from the other—Freire sexually assaulted one of the victims.

It was not until approximately 45 minutes after the women had lost consciousness that Freire contacted campus security, falsely claiming that they had passed out from excessive alcohol consumption. Before alerting security, he had already sent photos of the sexually assaulted victim—who was partially naked—to a friend.

Campus security, recognizing the signs of acute fentanyl poisoning, administered Narcan (an opioid antagonist) before the women were rushed to a hospital. The victim who had been sexually assaulted never regained consciousness and died from fentanyl poisoning on March 21; the other student eventually recovered and was discharged from the hospital. According to court documents, before meeting with two female students, Freire asked his 18-year-old acquaintance, Brian Peralta Cabrera, to provide drugs that would remain effective throughout the night. Freire remarked that if the students were to become addicted to the substances as a result, it would be a “win-win” situation.

Both Freire and Cabrera—the latter a resident of Queens—have been charged with conspiracy to distribute controlled substances resulting in death or serious bodily injury. These charges carry a mandatory minimum sentence of 20 years in prison and a maximum sentence of life imprisonment. Additionally, Freire faces charges for distributing controlled substances that resulted in death, as well as for providing controlled substances with the intent to commit sexual assault.
